MEA Guidelines for NRI Certificate
The Ministry of External Affairs (MEA) has revised the rules for issuing NRI Certificates through Indian Embassies and Consulates abroad.
Who Qualifies as an NRI?
As per Section 6 of the Income Tax Act, 1961:
- A person in India 182+ days in a year is considered Resident.
- If in India 60+ days in a year AND 365+ days in the last 4 years, they are Resident.
Exceptions:
- Indian citizens/PIO visiting India → threshold = 182 days.
- After Finance Act 2020, this was revised to 120 days for those earning above ₹15 lakh (excluding foreign income).
Finance Act, 2020 (effective Assessment Year 2021–22): (1)…The earlier rule of 60 days stay in India has been extended to 120 days if an Indian citizen or person of Indian origin has a total income (excluding foreign income) above ₹15 lakh in a financial year. (2)…A new Section 6(1A) was also added. It says that if an Indian citizen earns more than ₹15 lakh (excluding foreign income) and is not paying tax in any other country, then he or she will be treated as a Resident of India for tax purposes. |
Certificate Validity
- The NRI Certificate remains valid for 6 months from the date of issue.
- Indian embassies must verify immigration/emigration stamps on passports before issuance.
