As per the Supreme Court’s order in Contempt Petition, Shubhankar Patnaik vs. K. Ramesh Reddy & Others, the filtering out All India Quota (AIQ) candidates is now mandatory during NEET UG Counselling.
This step ensures that candidates who have already joined a seat under AIQ cannot simultaneously participate or be allotted another seat under State Quota Counselling, maintaining fairness and preventing seat blocking.
What Led to the Supreme Court’s Directive
In the Shubhankar Patnaik vs. K. Ramesh Reddy case, the Supreme Court observed several instances of seat blocking, where candidates joined AIQ seats and later participated in state counselling to switch seats.
This led to:
- Wastage of MBBS seats
- Delays in state-level seat allotment
- Unfair advantage to certain candidates
To prevent such misuse, the Court mandated strict filtering of joined AIQ candidates before states conduct their own seat allotment rounds.
MCC’s Official Directive: Key Highlights
The MCC notice 2025 states the following:
- Result of Round 3 of UG Counselling 2025 has already been published by MCC.
- There is no provision of resignation from the allotted AIQ seat after Round 3.
- Therefore, all State Counselling Authorities are directed to weed out or exclude candidates who have joined AIQ seats before conducting Round 3 of state counselling.
- This measure is mandatory to ensure that no candidate holding an AIQ seat is allotted a seat through state counselling.
- The list of joined AIQ candidates can be downloaded by state authorities from the MCC Data Sharing Portal after November 1, 2025.

What Does “Filtering Out AIQ Candidates” Mean?
The term ‘filtering out’ means that the state counselling software or processing team must cross-check and remove any student’s name who:
- Has been allotted and joined an AIQ seat in Round 3 (as per MCC’s joined candidate list), and
- Still appears in the state counselling registration list.
This ensures such candidates are not considered for further allotment at the state level.
No Resignation Allowed After AIQ Round 3
The MCC has clarified that:
- Once a candidate joins an AIQ seat after Round 3, resignation or withdrawal is not permitted.
- Hence, seat upgradation or switching between AIQ and State Counselling is not allowed after this stage.
- This rule aligns with the Supreme Court’s order to maintain the integrity of the counselling process and prevent misuse of the dual-counselling system.
Data Sharing Portal Access for States
To facilitate this process, MCC has enabled access to the Data Sharing Portal for all State Counselling Authorities.
- States can download the list of AIQ-joined candidates starting November 1, 2025.
- The data includes candidate name, roll number, category, college allotted, and joining status.
- This list should be integrated into the state seat matrix processing system before seat allotment for Round 3.
