Jodhpur: In a significant relief for Vyas Dental College & Hospital, Jodhpur, the Rajasthan High Court has directed the authorities to allow the institute to participate in the NEET UG stray-vacancy round for filling 50 additional BDS seats, which were recently restored for the 2025-26 academic session.
Background of the Dispute
The institute had an approved intake capacity of 100 BDS seats since 2007, but its seats were reduced to 50 by an order issued in July 2024.
The college challenged the reduction and secured favourable orders in multiple writ petitions in 2024 and 2025. Despite repeated court directions, the authorities did not restore the original intake in time for the early rounds of counselling.
On November 7, 2025, the state counselling authority finally restored the 100-seat capacity. However, the institute was then barred from participating in the mop-up round, with authorities citing that “no up-gradation can be allowed.”

Court Observations
Justice Sunil Beniwal observed that:
- The college already holds a valid restoration order for 100 seats for the 2025–26 session.
- Denying the institute participation in the mop-up round would make previous court orders ineffective.
- The objection raised under Regulation 17 of the 2023 Medical Education Regulations appeared “highly technical” and not substantial.

Interim Relief Granted
Pending the next hearing, the High Court has issued the following interim directions:
- Vyas Dental College must be allowed to participate in the stray-vacancy round for filling 50 restored BDS seats.
- All admissions made under this round will be strictly provisional and will not grant any equity to the students.
The court has also issued notices to the state counselling board and the central health ministry, giving them four weeks to respond.
